ELDER PATRIOT – Now that the Trans Pacific Partnership (TPP) and the Omnibus spending bill have finally been made public those who have actually taken the time to read them cannot believe that those who swore to protect and the Constitution signed them. Unfortunately there aren’t enough patriots left in either house of congress to begin impeachment proceedings.
Readers of this column know that I refrain from using the “impeachment” word because it is a serious endeavor that challenges, both, the separation of powers that our Founders worked so diligently to construct and the importance of free and open political debate. Because of that it has only been successfully employed a few times in our nation’s history and rightly so.
Hidden within the 5544-page TPP is the surrender of U.S. sovereignty to foreign tribunals should disputes arise between the signatory nations. What might those disputes look like? Well, for starters the Committee on Foreign Investment in the United States (CFIUS) has been responsible for reviewing proposed foreign investments on our shores expressly to determine if the investment in any way posed a threat to the national security of our country. If they determined that a commercial transaction was a threat they would then recommend to the president that he block that transaction. Sections of the TPP strip this authority from congress and the president.
Chapter 11 of TPP confers special rights on foreign investors should they choose to buy any of our land and natural resources or any other businesses or investments they choose.
This is spelled out in greater detail in Chapters 28 and 29. So, if the Saudis offered to buy mineral rights interests in Alaska’s North Shore in exchange for clearing all or some of our country’s debt, they would be able to. If our government moved to block the acquisition (a move like that appears more unlikely than ever before,) the Saudis could seek relief from a foreign tribunal consisting of three unelected foreign lawyers. Restitution would be based on lost profits, and fines would exacerbate the costs to the American taxpayers.
Other provisions hidden in this massive treaty pave the way for backdoor passage of the climate change treaty Obama recently signed onto in Paris. The pertinent section is Article 20.4:
“The Parties [recognize] that multilateral environmental agreements to which they are party play an important role, globally and domestically, in protecting the environment and that their respective implementation of these agreements is critical to achieving the environmental objectives of these agreements. Accordingly, each Party affirms its commitment to implement the multilateral environmental agreements to which it is a party.
The Parties [emphasize] the need to enhance the mutual supportiveness between trade and environmental law and policies, through dialogue between the Parties on trade and environmental issues of mutual interest, particularly with respect to the negotiation and implementation of relevant multilateral environmental agreements and trade agreements.”
In this instance, Chapter 27 of the TPP provides for Arbitration Tribunals with the authority to “punish” violators with multi-billion dollar fines for those deemed in violation.
According to a White House press release the United States has committed to reducing carbon emissions 28% below 2005 levels while China will be allowed to continue growing their emissions unfettered until 2030. With restrictions like this, what will be left of manufacturing jobs in our country?
While Constitutional lawyers I’ve discussed this with doubt the treaty will withstand testing in the courts, the Supreme Court’s ruling upholding Obamacare has shown us the court can’t be counted on to protect the peoples’ interests. More importantly, those who voted for this bill must be held accountable for their willingness to consider selling America’s sovereignty to foreign entities.
The Omnibus spending bill also directly threatens America’s sovereignty as well as the safety of her citizens. In a letter to the Obama administration, Senators Ted Cruz and Jeff Sessions outlined their concerns about the unfettered Islamic immigration invasion that was funded in its entirety by the Omnibus:
“Congress is days away from consideration of an omnibus year-end funding bill that would set the U.S. on an autopilot path to approve green cards, asylee, and refugee status to approximately 170,000 migrants from Muslim countries during the next fiscal year. In addition to that would tens of thousands of temporary visas for entry and employment, and the entire sum is added to the rest of the annual autopilot green card, asylee, refugee, and foreign worker flow.”

“In passing this legislation, the House has approved funding for the issuance of nearly three hundred thousand visas to migrants from Muslim countries in the next year alone. Ryan’s bill accomplishes this migrant surge by fully funding every U.S. immigration program currently in existence, as well as funding the President’s expansion of the refugee program through Syrian migrant resettlement.
The most recent available data published by the Department of Homeland Security shows that in 2013, around 118,000 migrants from Muslim-majority countries were permanently resettled within the United States on green cards, as well as approximately 40,000 refugees and asylees from Muslim countries. Additionally, according to data from the State Department, in 2013 the U.S. voluntarily admitted approximately 123,000 temporary migrants from Muslim countries as foreign students and foreign workers. On top of those autopilot admissions, which will be funded throughout all of 2016, the House is also funding the President’s plan to add another 10,000 refugees from the Muslim country of Syria. As a result, Ryan’s House-passed omnibus will bring in nearly 300,000 Muslim migrants in the next 12 months alone, including roughly 170,000 who will be permanently resettled within the country.”
You read that correctly, hidden within the 2009-page Omnibus is sufficient funding for hundreds of thousands of Muslims from Jihadi regions.
Surely the Omnibus would address illegal immigration, right? It does, indeed! It fully funds tax credits for illegals as well as providing the money necessary to resettle any and all illegals making it to our borders.
There should be no excuse for those members of congress who say they relied on leadership to guide them because they weren’t given time to read all 5544 pages of the TPP or the 2009 pages of the Omnibus. They should have demanded sufficient review time be granted or voted the treaty and the funding bill down. They were sent to Washington to do the work of the people who elected them not the work of leadership or the Globalist Elite. The fact that the annual compensation these traitors receive starts at four to five times what the average American who can find work earns should only make you madder.
